Terms of Service

1. Agreement

By accessing or using ATHOMIC (“the Service”), you agree to be bound by these Terms of Service (“Terms”). The Service is operated by ATHOM AS (org. 831 754 702), Kongens gate 51C, 7012 Trondheim, Norway (“ATHOM AS”, “we”, “us”).

If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. The Service

ATHOMIC is a B2B SaaS platform for automated price monitoring and repricing for e-commerce stores, primarily integrating with Shopify. We provide tools to track competitor prices, apply repricing rules, and manage product pricing.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your credentials and for all activity under your account.

You must be at least 18 years old and have the legal capacity to enter into contracts to use the Service.

4. Subscription and payment

Access to the Service requires a paid subscription. Subscription fees are charged in advance on a monthly or annual basis. All prices are exclusive of VAT unless stated otherwise.

Subscriptions automatically renew unless cancelled before the renewal date. Refunds are not provided for partial periods, except where required by applicable law.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorised access to other users' accounts or data.
• Use the Service to scrape data in ways that violate third-party terms of service.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.

6. Your data

You retain ownership of all data you upload to ATHOMIC. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service.

Our handling of personal data is described in our Privacy Policy.

7. Intellectual property

All intellectual property rights in the Service (software, design, documentation) are owned by ATHOM AS or its licensors. Nothing in these Terms transfers any IP rights to you.

8. Disclaimer of warranties

The Service is provided “as is” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that repricing decisions made by the Service will achieve any particular commercial outcome.

Pricing decisions made by ATHOMIC are automated suggestions. You remain solely responsible for all prices published to your store.

9. Limitation of liability

To the maximum extent permitted by Norwegian law, ATHOM AS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of revenue, loss of profits, or loss of data.

Our total liability for any claim arising under these Terms shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Termination

You may cancel your subscription at any time from your account settings. We may terminate or suspend your account immediately if you breach these Terms.

Upon termination, your right to use the Service ceases. We will delete your data in accordance with our Privacy Policy.

11. Governing law and disputes

These Terms are governed by Norwegian law. Any dispute shall be subject to the exclusive jurisdiction of the courts of Trondheim, Norway, unless mandatory consumer protection law in your country of residence provides otherwise.

12. Changes to these Terms

We may update these Terms at any time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
